Please find following an "Offer to Purchase" form.  This form was designed to be a quick, no hassle way for you to submit an offer on a boat that you find interesting, without having to personally visit our office. The form describes the terms of your offer. Notice that each step of the process is mentioned.  And you will have a clear understanding of what happens next with a minimum financial risk.

After you complete and submit this form, please print the resulting page with highlighted fields, sign, date, and mail it to us with a deposit check in order to confirm your offer.

It is agreed that the deposit is subject to the following conditions:

1) That the deposit will be held in good faith (and will not be deposited) until the Seller has agreed to the terms of this offer and that the Buyer has been informed of his acceptance.  The funds for the deposit will be held in escrow by the Agent, Helms Yacht Sales Inc. Helms Yacht Sales Inc. is authorized to use these funds only for expenses approved by the Buyer.

2) The vessel will be made available for sea trial and demonstration to the satisfaction of the Buyer. The time for sea trial shall be on or before:

4) The vessel will be made available for survey to the satisfaction of the Buyer. The surveyor shall be of the Buyer's choice and all cost, including haul-out, shall be the Buyer's expense. Terms of this agreement to be completed on or before:

5) All personal property taxes and penalties, if any are the responsibility of the Seller and are to be paid. The Buyer agrees to prorate the taxes prepaid by the Seller. The Buyer will pay from the date of closing to the end of the period of prepaid taxes.

6) Should sales tax or use tax be imposed on the vessel, the Buyer agrees to assume responsibility for the payment of this tax.

7.A) If the vessel is being sold in brokerage, the Buyer understands that the information concerning the vessel is offered in good faith. That Helms Yacht Sales Inc. or its agents make no representations expressed or implied regarding the condition of the vessel.  The Buyer will use the sea trail and the survey to arrive at his understanding of the vessel's condition. Any faults found will be resolved by a cash settlement between the Seller and the Buyer before the final payment. The Buyer agrees to purchase the vessel "as is, with all faults and no promise of warranty".

7.B) If the vessel is new, the Buyer agrees that all warranty items will be negotiated as per the original manufacture's instructions; Helms Yacht Sales Inc. will act as the manufacture's agent.

8) All deposits are fully refundable within 72 hours of the termination of this agreement. Funds will be disbursed only when all funds are collected from the Buyer, and when the Seller has furnished properly executed documents of title.
